    These Terms and Conditions govern access to and use of the website imaginarwebhouse.com<\/b> (the “Site”) and the engagement of the services offered by Imaginar Web House<\/b>, [company or owner name], identified with [tax ID \/ ID number] and domiciled at [address], [city], Colombia (hereinafter “Imaginar Web House”, “we”).<\/p>

    By browsing the Site, submitting a form or hiring any of our services, you accept these Terms. If you do not agree with them, please do not use the Site.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t

    Imaginar Web House provides web design, custom web development, UX\/UI design, branding and digital marketing services, as well as support and maintenance.<\/p>

    The information on the Site about services, scope, timelines and prices (“from”) is for reference only. The scope, final price, deliverables, timeline and conditions of each project are defined in the written proposal or quote<\/b> we send, which prevails over the general information on the Site.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t

    3. Quotes and engagement<\/h2>\t\t\t\t<\/div>\n\t\t\t\t

    Quotes are free and valid for the period stated in each one (30 calendar days if not stated). A project is considered engaged when the client accepts the proposal in writing (email, WhatsApp or signature) and pays the agreed down payment.<\/p>

    Prices are expressed in US dollars (USD) with their approximate equivalent in Colombian pesos (COP). Unless the proposal says otherwise, they do not include taxes, domain, hosting, software or third-party plugin licenses, or advertising budget.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t

    4. Payments<\/h2>\t\t\t\t<\/div>\n\t\t\t\t

    Unless otherwise agreed, projects are paid with a down payment to start and the balance on delivery or by milestones, as stated in the proposal. Publishing the site or delivering final files may be subject to full payment.<\/p>

    Payments are made through the methods stated in the proposal. Late payments may pause the project and change the timeline.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t

    5. Client obligations<\/h2>\t\t\t\t<\/div>\n\t\t\t\t

    The client agrees to deliver the content (copy, images, logos, access credentials) and the necessary feedback on time; delays in that delivery extend the project timeline.<\/p>

    The client warrants that it owns or is authorized to use the content it provides, and is liable to third parties for it.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t

    6. Revisions, changes and delivery<\/h2>\t\t\t\t<\/div>\n\t\t\t\t

    Each proposal states the number of revision rounds included. Changes beyond the approved scope are quoted separately.<\/p>

    A deliverable is considered approved when the client confirms it in writing or when 10 business days have passed since delivery without comments.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t

    7. Intellectual property<\/h2>\t\t\t\t<\/div>\n\t\t\t\t

    Once the full project price has been paid, the client acquires the economic rights over the custom final deliverables (designs, copy and code developed for it), under the terms of the proposal.<\/p>

    Third-party components (WordPress, Elementor, plugins, themes, fonts, stock images and others) are governed by their own licenses. Imaginar Web House retains ownership of its pre-existing tools, methodologies and reusable code, and may showcase the work in its portfolio unless a confidentiality agreement applies.<\/p>

    All content on the Site (copy, design, brand, logos and images) belongs to Imaginar Web House or its licensors and may not be reproduced without authorization.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t

    8. Warranty and support<\/h2>\t\t\t\t<\/div>\n\t\t\t\t

    We fix, at no cost, any malfunction attributable to our work that is reported within 30 days of delivery. This does not cover changes requested by the client, hosting failures, third-party updates or modifications made by other people.<\/p>

    Ongoing support and maintenance are provided under the plans or rates stated in the proposal.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t

    9. Cancellation and withdrawal<\/h2>\t\t\t\t<\/div>\n\t\t\t\t

    The client may cancel the project by giving written notice. In that case, the work completed to date will be invoiced and the down payment may be applied to cover it.<\/p>

    Since these are custom services that begin upon the client’s approval, the right of withdrawal under article 47 of Colombia’s Law 1480 of 2011 applies under the terms and exceptions established by law.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t

    10. Limitation of liability<\/h2>\t\t\t\t<\/div>\n\t\t\t\t

    Imaginar Web House does not guarantee specific ranking, traffic or sales results, as they depend on external factors such as search engine and ad platform algorithms.<\/p>

    We are not liable for damages arising from failures of external providers (hosting, payment gateways, cloud services), misuse of the site by the client, or force majeure. In any case, our liability is limited to the amount paid for the service that gave rise to the claim.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t

    These Terms are governed by the laws of the Republic of Colombia, in particular Law 1480 of 2011 (Consumer Statute) and Law 527 of 1999 (electronic commerce). Any dispute will first be settled directly and, if that is not possible, before the competent authorities of Colombia.<\/p>
